1. Acceptance of these Terms
By accessing or using the Lugovum website (the “Site”) or by submitting a request through our forms, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Site or our services.
You must be at least 16 years old to use the Site. If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Site and to contact us. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
These Terms apply to your use of pages including /, /solutions/, and /contact/, and any content, downloads, or communications that originate from the Site.
2. Description of services
Lugovum provides energy storage system support focused on efficiency optimization. Depending on the engagement, services may include site intake and requirements gathering, review of interval meter data and renewable production profiles, storage sizing support (power and energy), dispatch strategy recommendations, commissioning checklists, and guidance for monitoring and reporting KPIs.
The Site also provides informational resources about energy storage concepts such as self-consumption, peak shaving, backup readiness, inverter behavior, and operational monitoring. This educational material is general in nature and is not a substitute for engineering design, safety planning, or legal compliance advice.
Any timeline, system capacity discussion, or projected performance discussed on the Site or in initial consultations is an estimate based on assumptions and limited inputs. Final design and performance depend on site conditions, equipment selection, interconnection constraints, permitting requirements, and operating practices. We will explain the key assumptions we rely on when we provide deliverables.
Unless explicitly agreed in writing, Lugovum does not install physical equipment, does not act as the electrical contractor of record, and does not guarantee that a specific equipment model, utility program, or incentive will remain available. If we recommend third-party providers, you are responsible for selecting and contracting with them.
3. User obligations
You agree to use the Site only for lawful purposes and in a manner that does not violate any applicable laws, regulations, or third-party rights. You are responsible for ensuring that any information you submit is accurate, current, and not misleading.
If you submit site data or project details, you confirm that you have the right to share those details with Lugovum. Do not upload or send sensitive personal data such as government identification numbers, payment card data, or health information. If you include personal contact data for colleagues, you confirm that you have authority to provide that data for the purpose of project communications.
Where the Site enables inquiries or consultation requests, you agree that you will not use forms to send spam, solicitations, or content unrelated to energy storage services. You also agree not to interfere with the Site’s security features or attempt to access data not intended for you.
If any account features are introduced in the future, you agree to maintain one account per individual unless otherwise permitted, to maintain the confidentiality of your access credentials, and to notify us promptly of any suspected unauthorized access.
4. Intellectual property
The Site and its contents, including text, layouts, graphics, icons, and code, are owned by or licensed to Lugovum LLC and are protected by intellectual property laws. “Lugovum” and related branding are trademarks or service marks of Lugovum LLC.
Subject to your compliance with these Terms, Lugovum grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business purposes. You may not copy, reproduce, publish, distribute, publicly display, modify, create derivative works from, reverse engineer, or otherwise exploit any portion of the Site without our prior written permission.
If you provide feedback, suggestions, or ideas about the Site or our services, you grant Lugovum a royalty-free, worldwide license to use that feedback to improve our offerings, without any obligation to compensate you. This does not transfer ownership of your confidential business information, and we will handle any personal data according to our Privacy Policy.
5. Prohibited activities
You may not engage in any of the following activities in connection with the Site or our communications:
- Scraping, crawling, harvesting, or using automated means to extract data or content without permission.
- Attempting to probe, scan, or test the vulnerability of the Site, or bypassing access controls.
- Uploading or transmitting malware, ransomware, or any code designed to disrupt or damage systems.
- Impersonating any person or entity, or misrepresenting your affiliation with an organization.
- Using the Site to send spam, phishing attempts, or deceptive messages.
- Violating third-party intellectual property, confidentiality obligations, or privacy rights.
- Interfering with the normal operation of the Site, including through excessive requests or denial-of-service behavior.
We may investigate suspected violations and may suspend or block access as described in Section 13 (Termination).
6. Disclaimer of warranties
The Site and any informational content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Lugovum disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Lugovum does not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components. We do not guarantee that any information on the Site is complete, accurate, or current for your specific circumstances. Energy storage performance depends on many variables, including equipment configuration, interconnection limitations, tariff structures, weather, maintenance, and operational decisions.
Any guidance we provide is intended to support planning and decision-making but does not replace the work of licensed professionals responsible for electrical design, safety planning, permitting, and compliance. You are responsible for confirming technical suitability and safety with qualified providers before implementing changes in the field.
7. Limitation of liability
To the maximum extent permitted by law, in no event will Lugovum LLC, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of revenue, business interruption, loss of data, or loss of goodwill, arising out of or related to your use of the Site, your inability to use the Site, or any services or communications provided by Lugovum, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, Lugovum’s total aggregate liability for any claim arising out of or related to these Terms, the Site, or our services will not exceed the amount you paid to Lugovum for the services giving rise to the claim in the 12 months before the event that first gave rise to the claim, or one hundred euros (€100), whichever is lower.
Some jurisdictions do not allow certain limitations of liability. Where such limitations are prohibited, the above limitations will apply to the extent permitted by applicable law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Lugovum LLC and its officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) your infringement of any third-party rights, including intellectual property or privacy rights.
We may assume the exclusive defense and control of any matter subject to indemnification by you. In that case, you agree to cooperate with our defense and not to settle any such matter without our prior written consent.
9. Third-party links and services
The Site may reference third-party products, services, or resources in the context of energy storage, monitoring, and efficiency optimization. Any such references are for informational purposes. Lugovum does not control third-party websites or services and is not responsible for their content, terms, privacy practices, or availability.
If you choose to engage a third-party vendor, installer, integrator, or software provider, your relationship is directly with that third party. You are responsible for reviewing their contracts, insurance, licensing, safety practices, and compliance obligations.
10. Privacy
Your use of the Site is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what personal data we collect, how we use it, and the choices available to you, including cookie preferences and deletion requests.
If you contact us through forms on the Site, you agree to provide only the information necessary to respond to your request. We encourage you not to include sensitive personal information in free-text fields.
11. Governing law and jurisdiction

You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.
12. Dispute resolution
Before filing a claim, you agree to attempt to resolve any dispute informally by contacting us at [email protected] and providing a brief written description of the issue and the relief sought. The parties will attempt in good faith to resolve the dispute within 30 days from receipt of the notice.
If the dispute is not resolved within the informal resolution period, either party may pursue a claim in accordance with Section 11 (Governing law and jurisdiction). Nothing in this section prevents either party from seeking injunctive or equitable relief where appropriate to prevent irreparable harm.
13. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in prohibited activity, or used the Site in a way that could create risk or legal exposure for Lugovum or others.
Termination does not limit any rights or remedies we may have at law or in equity. Sections that by their nature should survive termination will survive, including Intellectual Property (Section 4), Prohibited Activities (Section 5), Disclaimer of Warranties (Section 6), Limitation of Liability (Section 7), Indemnification (Section 8), Governing Law (Section 11), and Dispute Resolution (Section 12).
14. Modifications to these Terms
We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. Updated Terms will be posted on this page with a revised “Last Updated” date.
Unless a change is required to take effect sooner for legal reasons, changes will become effective 14 days after posting. Your continued use of the Site after the effective date constitutes your acceptance of the revised Terms.
